Deliveristas - You Have New Labor Rights!

New Labor Rights/ Nuevo Derechos Laborales

Los Deliveristas Unidos/Worker’s Justice Project obtained another major victory in New York City, when more than 65,000 app delivery workers will have new labor rights, such as bathroom access, minimum pay and other provisions.  


For more than a year, Los Deliveristas Unidos have been on the street organizing and representing the NYC delivery workers across the five boroughs. Finally, after a long hard fight, on September 23, 2021, NYC City Council delivered justice to Deliveristas as they passed a groundbreaking package of legislation in NYC that introduced new labor standards and rights to app delivery workers. By the approval of these bills - the New York City Council set an example for the rest of the state and the country in how to protect, respect, and honor our Essential But Unprotected App Delivery Workers, particularly as we continue the city’s efforts to fight COVID-19 and continue our economic recovery.    


The NYC Department of Consumer Affairs & Workers Protection (DCWP) will implement the new law regulating delivery apps and worker protections for app delivery workers. The App Delivery Workers rights will have three phases of implementation, the first phase will start Monday, January 24, 2022.  


Phase 1 - Date of Implementation - January 24, 2022  


  • Many food delivery apps must be licensed by DCWP to operate in NYC.  Apps must notify Deliveristas how much the customer tips for each delivery. 
  • Apps notify Deliveristas the total pay and tips for the previous day. Deliveristas will have better access to restaurant bathrooms when you pick up orders. 


Phase 2 - Implementation Date: April 22, 2022   


  • Deliveristas will have more control over your deliveries. App delivery workers can limit how far you will go from restaurants and refuse to use bridges or tunnels.   
  • Apps must inform Deliveristas the route details before they accept a delivery. Delivery Notification must include address for pickup, estimated time and distance for trip, tip if known, total pay.   
  • Apps must pay Deliveristas at least once a week. Apps cannot charge a fee to process their payment.    Apps must provide Deliveristas a free insulated food delivery bag after 6 deliveries. 


Phase 3 - Date of Implementation: January 1, 2023 

  • Apps must pay Deliveristas the new minimum pay rate that the City will set.
